Macabre Intentions Terms and Conditions

Thank you for choosing Macabre Intentions. By placing an order with us, you agree to the following terms and conditions. These terms exist to ensure a clear, transparent, and fair custom-creation process for our handmade costumes.

1. Custom-Made Nature of Products

All costumes are either original designs created by Macabre Intentions or are made-to-order specifically for you. We do not sell stock or off-the-shelf items.

Custom orders begin fabrication only after your order is placed and the required 50% non-refundable deposit is received.

Fabrication is considered to have begun once any of the following occur: materials are purchased or cut, patterns are drafted, sculpting, molding, painting, sewing, or assembly begins.

Due to the handmade, bespoke process, final dimensions, weight, materials, and appearance may vary slightly from initial descriptions, mockups, or photos. Minor variations are natural, inherent to handmade work, and are not considered defects.

2. Order Process and Payments

  • A 50% non-refundable deposit is required to begin all custom orders.
  • The remaining balance, plus exact shipping costs, is due before shipment.
  • All orders must be paid in full prior to delivery.

  • Any applicable sales tax will be added where required by law.

Failure to complete payment once fabrication is complete may result in delayed shipment or order cancellation, with all deposits forfeited.

3. Shipping

  • Most orders ship via UPS. Large or heavy items may ship via a freight carrier; smaller items may ship via USPS. All shipments are insured.
  • Shipping costs vary based on final weight, dimensions, and destination and can only be calculated once the costume is complete. You will be contacted with the final shipping cost for approval prior to charging.
  • Shipping charges are non-refundable.
  • Macabre Intentions is not responsible for delays, loss, or damage caused by shipping carriers.
  • Customers are responsible for providing an accurate shipping address.
  • International customers are responsible for all customs fees, duties, taxes, or import charges.
  • ALL ORDERS MUST BE PAID IN FULL BEFORE SHIPMENT.

4. Order Cancellation and Returns

  • Custom orders may be cancelled only if fabrication has not yet begun. In such cases, the deposit is forfeited.
  • Once fabrication has begun, orders are non-cancellable, and the customer remains responsible for the full agreed-upon order price according to the original payment terms.
  • Due to the custom, handmade nature of our work, all costumes are final sale and may not be returned, exchanged, or refunded, except in cases of verified shipping damage covered by carrier insurance (see Section 5).
  • We provide progress photos throughout the creation process to ensure alignment with the approved design and to minimize surprises. Approval at any stage constitutes acceptance of work completed to that point.

5. Product Damage and Insurance Claims

If your costume arrives damaged, you must notify us within 7 days of delivery via email and include clear photos of both the damage and the original packaging. We will assist with filing an insurance claim with the carrier. Claims reported after 7 days may not be eligible for insurance reimbursement.

6. Handmade Nature and Fit Considerations

All items are individually handmade. Slight variations in color, texture, stitching, fit, or finish may occur and are not considered defects.

If measurements, sizing details, or fit preferences are provided by the customer, Macabre Intentions is not responsible for inaccuracies resulting from incorrect or incomplete information supplied by the customer.

7. Disclaimers and Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • Macabre Intentions disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Any references to “best efforts” or similar language describe our creative process and do not constitute a guarantee or warranty of outcome.
  • Our products are intended for costume and cosplay use only and are not designed for heavy-duty, prolonged, hazardous, or professional use unless explicitly stated.
  • Customers assume all risks associated with wearing or using our costumes, including but not limited to visibility limitations, restricted movement, heat retention, allergic reactions, improper fit, or injury resulting from normal or improper use.
  • In no event shall Macabre Intentions, its owners, or representatives be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from the purchase, use, or misuse of our products, even if advised of the possibility of such damages.
  • We are not responsible for typographical errors, inaccuracies, or omissions in descriptions, pricing, or images.
  • Macabre Intentions is not liable for delays or non-performance due to events beyond our reasonable control, including but not limited to supply shortages, carrier delays, natural disasters, illness, or other force majeure events. Such events may extend production timelines without penalty.

8. Governing Law and Venue

These terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-laws principles. Any legal action or proceeding arising from these terms or the purchase of our products shall be brought exclusively in the state or federal courts located within Wisconsin.
